JURY DUTY/MATERIAL WITNESS/CRIME VICTIM LEAVE

Summary

Employees are encouraged to serve on jury duty and fulfill their court-related, civic obligations. Maricopa Community Colleges provides full-time regular classified, non-classified staff and full-time regular faculty paid time off to do so without a change in status or loss of pay.  Details are located in the Staff Policy Manual: Policy A-6 and the Residential Faculty Agreement Article 12.3. Jury Duty, Material Witness, or Crime Victim Leave Policy Details

Employees are encouraged to serve on jury duty and fulfill their court-related, civic obligations. Maricopa Community Colleges provides full-time regular classified, non-classified staff and full-time regular faculty paid time off to do so without a change in status or loss of pay.  Details are located in the Staff Policy Manual: Policy A-6 and the Residential Faculty Agreement Article 12.3

Procedures
  • The staff or faculty members notified of the obligation to serve on a jury or subpoenaed to appear in court as a material witness shall immediately present a copy of the office notice, summons, or subpoena to their immediate supervisor or department chair. Time off requests for jury duty must be entered as an Absence request through HCM
    • Log in to HCM
    • Go to Time tile > Manage Absences tile > 
    • Select Start & End Date
    • Select "Jury Duty" for the Absence Name drop-down box and select the Apply Absence button
    • Select "Jury Duty" or "Material Witness Duty" in the Reason drop-down box
    • If you will be out for the entire day, select the Submit button
    • Individuals summoned for jury duty or appearing as subpoenaed witnesses are expected to work during normal working hours whenever the court is not in session or when their presence in court is not required. An employee released from jury duty or material witness duty prior to the end of the employee's scheduled workday shall report for the remaining hours of work.
      • If this is the case, select the Partial Days button,
      • Change "None" to "All Days" and enter the number of hours you were off in the Durations box.
      • Select Done and confirm that those hours are now showing in the Durations box.
    • "Submit" Absence Request
  • Employees on paid leave due to eligible jury or material witness duty shall turn over to the District the sums paid to them by the court (other than mileage or subsistence allowances).
    • You can reimburse the College Fiscal/Cashier's office by signing over the check to them. They will, in turn, cash the check and reimburse you for any mileage or subsistence that was included in the check.
    • You can also cash the check from the court and reimburse the District/Fiscal/Cashier office for the per diem payment. We suggest that you make a copy of the check for their reference.
    • The use of such leave shall be noted on the employee’s time record for payroll purposes.
  • Material witness duty leave is not available to employees whose court appearance relates to or arises from the employee’s commercial, business, or other personal matters, or relates to the employee’s own misconduct or unlawful conduct. Individuals appearing in court on their own behalf are required to use their accrued vacation, compensatory, or personal time to cover such period of absence, and no reimbursement of court per diem payments is required.
